Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Rewind Health Pty Ltd ("Rewind", "we", "us", or "our"). By accessing or using our website, applications, and services (collectively, the "Platform"), you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform. Your continued use after such changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to create an account and use the Platform. By registering, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

To access certain features, you must create an account with accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised access or security breach

We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.

4. Subscription and Billing

4.1 Plans and Pricing

Rewind offers subscription-based plans. Current pricing and plan details are displayed on the Platform. All prices are in Australian Dollars (AUD) unless otherwise stated.

4.2 Recurring Charges

Subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless cancelled before the renewal date. By subscribing, you authorise us to charge your designated payment method on a recurring basis.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of that period.

4.4 Refund Policy

Subscription fees are generally non-refundable. However, we may offer refunds at our discretion in exceptional circumstances. Australian Consumer Law guarantees apply to the extent required by law.

5. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorised access to any part of the Platform or its systems
  • Interfere with or disrupt the Platform, servers, or networks
  • Scrape, crawl, or use automated means to access the Platform without our written consent
  • Impersonate any person or entity, or misrepresent your affiliation
  • Upload malicious code, viruses, or other harmful material
  • Share your account credentials with others or allow multiple individuals to use a single account
  • Use the Platform to provide medical advice or services to third parties without appropriate qualifications and authorisation

6. Health Information Disclaimer

The Platform is not a substitute for professional medical advice, diagnosis, or treatment.

  • Rewind provides informational and supportive health optimisation tools. Content, insights, and recommendations on the Platform are for general wellness purposes only.
  • AI-generated insights and recommendations are not medical diagnoses and should be reviewed by a qualified healthcare professional before acting upon them.
  • Biological age assessments and biomarker analyses are informational tools and should not be interpreted as clinical diagnoses.
  • Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or received through the Platform.
  • In a medical emergency, call 000 (Australia) or your local emergency number immediately. Do not use the Platform for emergency medical situations.

7. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, software, algorithms, and design elements — are the exclusive property of Rewind Health Pty Ltd or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Platform content without our prior written consent.

8. User Content

You retain ownership of any content you submit to the Platform (such as questionnaire responses, uploaded documents, and profile information). By submitting content, you grant Rewind a non-exclusive, worldwide, royalty-free licence to use, process, and store that content solely for the purpose of providing and improving our services.

You represent that you have the right to submit any content you provide and that such content does not infringe the rights of any third party.

9. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REWIND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, error-free, or secure
  • Results obtained from the Platform will be accurate or reliable
  • Any specific health outcomes will be achieved through use of the Platform
  • Defects in the Platform will be corrected within any particular timeframe

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REWIND HEALTH PTY LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO REWIND IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including Australian Consumer Law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rewind Health Pty Ltd and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content you submit to the Platform

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us or through your account settings.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) shall continue to apply.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that jurisdiction for any disputes arising from or in connection with these Terms.

14. Dispute Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@rewind.health. We will endeavour to resolve the matter within thirty (30) days. If the dispute cannot be resolved informally, either party may pursue resolution through the courts as outlined in Section 13.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
